In continuation of FAQ series on the subject matter of "𝗧𝗵𝗲 𝗠𝗼𝘀𝘁 𝗖𝗼𝗺𝗺𝗼𝗻 𝗜𝗣 𝗤𝘂𝗲𝘀𝘁𝗶𝗼𝗻𝘀 𝗪𝗲 𝗛𝗲𝗮𝗿 𝗳𝗿𝗼𝗺 𝗙𝗼𝘂𝗻𝗱𝗲𝗿𝘀 - 𝗔𝗻𝘀𝘄𝗲𝗿𝗲𝗱", here is the Twenty- Fourth question is answered below in the series.


𝗜𝗻𝗱𝗶𝗮𝗻 𝗣𝗮𝘁𝗲𝗻𝘁 𝗚𝗿𝗮𝗻𝘁 𝗧𝗶𝗺𝗲𝗹𝗶𝗻𝗲 & 𝗙𝗮𝗰𝘁𝗼𝗿𝘀


𝗧𝘆𝗽𝗶𝗰𝗮𝗹 𝗧𝗶𝗺𝗲𝗹𝗶𝗻𝗲: A patent grant in India generally takes 𝟯-𝟱 𝘆𝗲𝗮𝗿𝘀 from the date of filing, though this can vary.


𝗧𝗶𝗺𝗲𝗹𝗶𝗻𝗲 𝗕𝗿𝗲𝗮𝗸𝗱𝗼𝘄𝗻:


𝗙𝗶𝗹𝗶𝗻𝗴 𝘁𝗼 𝗘𝘅𝗮𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻 𝗥𝗲𝗾𝘂𝗲𝘀𝘁: Up to 31 months.


𝗘𝘅𝗮𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻 𝗮𝗻𝗱 𝗙𝗶𝗿𝘀𝘁 𝗘𝘅𝗮𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻 𝗥𝗲𝗽𝗼𝗿𝘁 (𝗙𝗘𝗥): 6-12 months after the Request for Examination (RFE) is filed.


𝗥𝗲𝘀𝗽𝗼𝗻𝘀𝗲 𝘁𝗼 𝗘𝘅𝗮𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻 𝗥𝗲𝗽𝗼𝗿𝘁: 6 months (with a possibility of extension).


𝗙𝗶𝗻𝗮𝗹 𝗗𝗲𝗰𝗶𝘀𝗶𝗼𝗻/𝗚𝗿𝗮𝗻𝘁: 6-12 months after all compliance requirements are met.


𝗙𝗮𝗰𝘁𝗼𝗿𝘀 𝗔𝗳𝗳𝗲𝗰𝘁𝗶𝗻𝗴 𝗧𝗶𝗺𝗲𝗹𝗶𝗻𝗲: 

Complexity of the invention.  

Examination backlog at the Patent Office.

Quality and speed of the response to official objections.

Presence of pre-grant or post-grant oppositions.


𝗘𝘅𝗽𝗲𝗱𝗶𝘁𝗲𝗱 𝗘𝘅𝗮𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻:This option is available for specific applicants, such as startups, MSMEs, and certain other categories, allowing for significantly faster processing.


𝗥𝗲𝗰𝗲𝗻𝘁 𝗜𝗺𝗽𝗿𝗼𝘃𝗲𝗺𝗲𝗻𝘁𝘀: Government initiatives are focused on reducing the total examination time, with a target of 18 months (down from the previous 5-year average).


𝗠𝗮𝗶𝗻𝘁𝗲𝗻𝗮𝗻𝗰𝗲 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗺𝗲𝗻𝘁: Annual fees must be paid both during the prosecution phase and after the patent is officially granted.


𝗦𝘁𝗿𝗮𝘁𝗲𝗴𝗶𝗰 𝗣𝗹𝗮𝗻𝗻𝗶𝗻𝗴: Businesses should plan their commercial strategies considering these timelines and ensure continuity of R&D activities during the process.
