In continuation of FAQ series on the subject matter of "𝗧𝗵𝗲 𝗠𝗼𝘀𝘁 𝗖𝗼𝗺𝗺𝗼𝗻 𝗜𝗣 𝗤𝘂𝗲𝘀𝘁𝗶𝗼𝗻𝘀 𝗪𝗲 𝗛𝗲𝗮𝗿 𝗳𝗿𝗼𝗺 𝗙𝗼𝘂𝗻𝗱𝗲𝗿𝘀 - 𝗔𝗻𝘀𝘄𝗲𝗿𝗲𝗱", here is the Twenty- Eighth question is answered below in the series.



𝗙𝗶𝗹𝗶𝗻𝗴 𝗜𝗻𝘁𝗲𝗿𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗣𝗮𝘁𝗲𝗻𝘁 𝗔𝗽𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻𝘀 𝗳𝗿𝗼𝗺 𝗜𝗻𝗱𝗶𝗮


𝗜𝗻𝘁𝗲𝗿𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗥𝗼𝘂𝘁𝗲𝘀:

𝗣𝗖𝗧 𝗥𝗼𝘂𝘁𝗲: File an International application through the Patent Cooperation Treaty (PCT), which covers over 150 countries.


𝗖𝗼𝗻𝘃𝗲𝗻𝘁𝗶𝗼𝗻 𝗥𝗼𝘂𝘁𝗲: File directly in individual countries within 12 months of the initial Indian filing date.


𝗣𝗿𝗲𝗿𝗲𝗾𝘂𝗶𝘀𝗶𝘁𝗲𝘀 & 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗺𝗲𝗻𝘁𝘀:

𝗙𝗼𝗿𝗲𝗶𝗴𝗻 𝗙𝗶𝗹𝗶𝗻𝗴 𝗣𝗲𝗿𝗺𝗶𝘀𝘀𝗶𝗼𝗻: Must obtain permission under Section 39 of the Indian Patents Act before filing abroad if the invention was made in India.


𝗜𝗻𝗱𝗶𝗮𝗻 𝗙𝗶𝗹𝗶𝗻𝗴 𝗙𝗶𝗿𝘀𝘁: Generally, the application must be filed first in India before filing abroad (within 12 months).


𝗣𝗿𝗶𝗼𝗿𝗶𝘁𝘆 𝗕𝗲𝗻𝗲𝗳𝗶𝘁𝘀: The initial Indian filing provides the priority date for subsequent international filings.


𝗞𝗲𝘆 𝗧𝗶𝗺𝗲𝗹𝗶𝗻𝗲𝘀 & 𝗖𝗼𝘀𝘁𝘀:

𝗣𝗖𝗧 𝗡𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗣𝗵𝗮𝘀𝗲 𝗘𝗻𝘁𝗿𝘆: Must enter the national phase in specific countries generally within 31 months from the earliest priority date.


𝗖𝗼𝘀𝘁𝘀: International filing is significantly more expensive than filing only in India.
