Does a Registered Trademark Last Forever?

Short answer: No. And missing a renewal deadline can cost you the brand name you've spent years building.


The Myth Most Founders Believe

Once you get your trademark registration certificate, your brand name is protected for life.

It's an understandable assumption. The registration process is long, sometimes tedious, and when the certificate finally arrives it feels like a permanent achievement. But trademark protection in India doesn't work that way.


How Long Does a Trademark Registration Actually Last?

A registered trademark in India is valid for 10 years from the date of application — not from the date the certificate is issued. This distinction matters because trademark grants in India can take anywhere from 2 to 4 years after filing, meaning many brand owners are already a few years into their 10-year window by the time they even receive the certificate.


After 10 years, the trademark must be renewed. The renewal window typically opens 6 months before the expiry date. If you miss it, there's a grace period — but once that's gone too, the mark lapses and your protection ends.


The Non-Use Rule: Another Way You Can Lose Your Trademark

Even a valid, registered trademark can be challenged if it hasn't been used in commerce for 5 consecutive years. This is called a non-use cancellation action, and any third party can file one if they believe your mark has been sitting idle.

In practical terms, this means:

  • A competitor who wants your brand name can petition the Trade Marks Registry to cancel your registration on grounds of non-use

  • The burden is on you to prove you've been actively using the mark

  • "Use" generally means genuine commercial use — not just internal references or occasional social media mentions

This is why registered trademarks need active management, not just a one-time filing.


What Happens If Your Trademark Lapses?

If a trademark lapses due to non-renewal, it doesn't immediately become available to others  there's a restoration window. But if that too is missed, the mark enters a period where anyone can apply for it. If someone else files for your brand name during this time, you could end up in a dispute over a name you originally registered and paid to protect.

Starting the registration process over also means losing your original priority date, which can matter significantly if there are other similar marks in the pipeline.


How to Keep Your Trademark Safe

Renew on time. Track your trademark's expiry date and set reminders well in advance. Renewal applications can be filed up to 6 months before expiry.

Keep using it. Maintain records of your trademark in actual commercial use — invoices, packaging, advertisements, website references — in case you ever need to defend against a non-use challenge.

Monitor it. Watch for similar marks being filed by others. Early opposition is far easier than litigation after someone else has already built a brand around a name similar to yours.
